Building Safety Solutions, Inc. (“BSS,” “we,” “us,” or “our”) respects the privacy of our customers and users. This Privacy Policy explains the type of personal information that we collect and how we collect, use, access, disclose, safeguard, store and otherwise process personal information when you use our websites, services and our products: BSS Guardian, BSS First Responder, and BSS Archangel, including any updates or additional products BSS provides to Customers (together, the “Services”).
The Services are provided to organizations (corporations or governmental entities, including without limitation, any building owners, property managers, or other legal entities) that purchase the Services for their permitted users (“Customers”). Customers decide who may use the product and what data is entered. BSS processes any personal information that Customers provide to use with the Services.
In addition, BSS may process personal information for visitors of our website as further described in this Privacy Policy.
Please read this Privacy Policy carefully, and if you do not agree with the terms of this Privacy Policy, please do not access or use the Services. Your continued use of the website or Services is your acknowledgment and agreement (i) to the terms of our Privacy Policy and any other applicable agreement that may be provided together with the Services, and (ii) that we have your permission to collect and process your personal information as described in this Privacy Policy. If you’re agreeing to this Privacy Policy on behalf of an organization or entity, you represent and warrant that you are authorized to agree to this Privacy Policy on behalf of that organization or entity and to bind them to these provisions (in which case, the references to “you” and “your” in this Privacy Policy, except for in this sentence, refer collectively to you personally and to that organization or entity).
We may need to make changes to this Privacy Policy as privacy laws change, our Services evolve, or we add or change service providers among other things. As a result, we reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Effective Date” of this Privacy Policy. Your continued use of the Services following the posting of any updated version of this Privacy Policy means you have agreed to the updated version.
1. Information BSS collects
Account and profile information you or your organization (Customer) provides
Name, email, phone number, postal address, current position, job title, employer, location such as building, user ID, and login credentials (or a magic-link invitation). We do not collect credit-card numbers in the applications unless you are working with a separate billing page for the specific purpose of payment of the Services.
Information entered in the Services
The type of personal information that is entered into or accessed by the Services may depend on the particular BSS product each Customer has purchased (see Section 2). This could include, without limitation, photographs, images, locations, videos, and other recordings that are uploaded to the Services.
Automatically collected information
Limited technical data is collected from your access or use of the website or Services, such as product usage data, or other information needed to operate the Services (for example, and including without limitation, device type, browser type and version, internet service provider domain, clickstream data, app version, approximate time of access, and log data for security and troubleshooting). The mobile applications are not designed to collect precise GPS location of your device. They also are not designed to automatically harvest contacts or other data from your device beyond what you or the Customer’s administrator submit.
Website
If you visit our website at: buildingsafetysolutions.com, we may collect contact-form submissions and standard server logs, as well as any preferences for marketing communications or your interest in any of our Services.
Cookies
We may collect cookies, web server logs, web beacons or other technical information from your use of the Services or the website. Please see the Cookies section below for further information.
Third Party Business Partners
We may collect personal contact details, IP addresses, account information, usage data, browser information, pages viewed, cookies, or other interactions with our website or Services that our third party business partners may collect.
2. Product-specific information
BSS Guardian
This BSS product is a workplace tool that Customer purchases for their employees and other permitted users that is primarily used for incident-related communications, training/compliance tracking, response-team records, and self-reporting registries, and information that it may collect in the performance of the Services, includes but is not limited to, the following type of information, which could include personal information:
- requests for evacuation assistance;
- “I’m Here” (designated persons indicating they are on the premises);
- “I’m Safe” (persons declaring they are safe during or after an incident);
- training completion and live-training records; or,
- incident or suspicious-activity reports submitted to Customer administrators.
Registry and report entries are supplied by users (you) or by the Customer’s staff. BSS does not independently verify that any person is present, safe, or in need of assistance.
BSS First Responder
This BSS product is an incident-response tool for in-house staff, and some features may include action/interactive cards, interactive floor plans, two-way messages among authorized staff, and incident reports used by the Customer for internal response, compliance, or audit purposes. Message and report content is Customer data, and may include personal information, visible to administrators the Customer authorizes as well as to BSS and our service providers on the back end; provided that, BSS does not independently verify that any person is present, safe or in need of assistance.
BSS Archangel
This BSS product is a digital operations-plan records for building systems the Customer chooses to document (for example, fire and life safety, water, HVAC, electricity) and related compliance/audit files. This is operational documentation the Customer uploads or enters, not live control of those systems. BSS Archangel may include some incidental access to personal information. BSS does not independently verify that these records are safe or accurate, as that is Customer’s responsibility.
3. How we use information
- Provide, maintain, and secure the Services, including without limitation, facilitating communications between you and us; creating and administering user accounts; delivering features a Customer purchases or enables;
- Protecting BSS, customers and any permitted users against identity theft, preventing fraud and other criminal activity;
- Manage our contractual relationship with Customers, including providing you with information regarding the Services, troubleshooting, system maintenance, and other customer support needs;
- Comply with any legal, regulatory or industry standard obligation, such as complying with this Privacy Policy, intellectual property infringement, enforcing any agreement with Customers;
- Improve the Services as well as the security and other related system and network functions; and/or,
- Perform analytics; market and consumer research, anonymization and aggregation of personal information, monitoring usage of the Services; and otherwise conducting marketing activities in accordance with applicable laws including working with third party advertisers, such as Google, who may use cookies and other technologies to collect website information and mobile information to serve online ads to you that may be of interest to you.
We do not sell personal information. We may create aggregated, de-identified and/or anonymized data from your personal information and other individuals whose personal information we collect. We make personal information into de-identified and/or anonymized data by removing information that makes the data identifiable to you. We may use this aggregated, de-identified and/or anonymized data and share it with third parties for our lawful business purposes, including to analyze and improve the Services and promote our business. We will not attempt to re-identify any such data, except as permitted by law.
4. How we share information
We may disclose information for the following purposes:
- to the Customer organization that invited you to access and use the Services and any authorized administrators or other support personnel of such Customer;
- to service providers that host or support the Services, who may use the information only to perform the Services for BSS;
- if required by law, regulation, subpoena, or similar processes;
- when we believe in good faith it is necessary to protect rights or safety, investigate fraud, or respond to a government request;
- for marketing and communications purposes; or
- in connection with a merger, acquisition, or sale of assets, subject to this Privacy Policy.
We may disclose information to the following parties:
- third party service providers;
- third party advertisers in connection with the website or the Services (provided, you can opt out of receiving any such communications);
- Customer’s administrators and other support personnel;
- third party business partners who may provide certain portions of the Services as further detailed in the description of the Services;
- with professional advisors and other consultants who assist us in the operations of the BSS business; or
- to potential acquiring or acquired organizations as part of any potential or actual merger, acquisition or sale of assets.
5. Customer control
Your employer or Customer decides which Services to purchase, including any permitted user employees who may access the Services, what modules are on as part of the Services, how long records are kept for their program within the Services, and any personnel inside the Customer’s organization who has access to registries, messages, floor plans, or operations plans.
6. Opt-out and access
You can stop use of a mobile app by uninstalling it. That does not erase records your organization, the Customer, has already stored for compliance. To request access, correction, or deletion of information BSS holds, please send an email to: privacy@bssnet.com. We will respond in a reasonable time. Some data must remain for the Services to perform as intended or due to the Customer or the law requiring retention of such data.
7. Retention of information
We retain information while the Customer subscription to the Services is active and for a reasonable period of time afterwards. Automatically collected log and other technical information may be kept up to 24 months, then stored only in aggregate where practical. Incident, training, registry, and operations plan records may be kept longer if the Customer requires a longer retention period for certain purposes such as compliance or audit. We may also keep personal information for marketing purposes for a longer period of time, unless you have opted out of receiving marketing communications in accordance with applicable law.
8. Minors
The Services are not directed to children under 13, and we do not knowingly collect any personal information of children. If you believe we have collected any personal information of a minor, please send an email to: privacy@bssnet.com and we will delete it in a reasonable time. Any use or access to the Services by individuals under the age of 13 (or the equivalent minimum age in the jurisdiction where you reside) is strictly prohibited and is a violation of this Privacy Policy.
9. Security
We use physical, administrative, technical, electronic, and procedural security safeguards to protect your personal information, including without limitation, to protect your personal information against loss, theft and misuse, as well as unauthorized access, disclosure, alteration and destruction. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information.
10. International users
The Services are operated in the United States. If you are outside the U.S., your information will be processed and stored in the United States.
11. Changes
We may update this Privacy Policy from time to time. We will post the new version of the Privacy Policy with an updated Effective Date. Continued use of the Services after the Effective Date of the applicable version of the Privacy Policy is acceptance of the updated Privacy Policy.
12. Consent
By using the Services, you consent to processing of your personal information as described in this Privacy Policy, including processing of personal information in the United States.
13. Cookies
Use of Cookies and Other Data Collection Tools
Like many website owners and operators, we use automated data collection tools such as Cookies and Web Beacons to collect certain information.
• “Cookies”
Are small text files that are placed on your device by a web server when you access a website. To enable our systems to recognize your browser or device and to provide and improve the Services, we may use both session Cookies and persistent Cookies. We may also use Cookies to monitor aggregate usage and web traffic routing on our Services and to customize our Services. • “Web Beacons” (also known as Web bugs, pixel tags or clear GIFs)
Are tiny graphics with a unique identifier that may be used for several purposes, including to deliver or communicate with Cookies, to track and measure the performance of our Services, to monitor how many visitors view our website, and to monitor the effectiveness of our advertising. Unlike Cookies, which are stored on the user’s device, Web Beacons are typically embedded invisibly on web pages (or in an e-mail).
